A woman got in touch with me after several weeks of serious problems at work. She was being asked to work more hours than agreed, they were not always paid, and her time off was not being properly respected.
The situation was no longer just an inconvenience: she needed to know what her rights were and how to defend them.
Then came the question:
“Can I take out legal protection insurance now so that it deals with this case?”
She can take out cover for future problems, but a new policy normally does not cover a dispute that had already started before the insurance began.
This story sums up the main mistake many people make with legal protection insurance in Switzerland: thinking about it only when they already need it.
Send me your current policy and we will review its areas of cover, insured persons, limits, waiting periods and exclusions.

Legal protection insurance, or Rechtsschutzversicherung, gives you access to legal guidance and representation in the areas included in your contract.
Depending on the product, it may cover costs such as:
- advice from legal experts;
- representation by lawyers;
- the costs of proceedings before authorities or courts;
- expert reports and mediation;
- certain legal costs awarded to the other party;
- and other costs expressly provided for in the policy.
The most common disputes don’t always look like “legal cases” at first
A legal problem rarely starts in a courtroom. It usually begins with an email, an invoice, a letter or a conversation that doesn’t get resolved.
Work
- unpaid overtime;
- a dismissal you believe is unfair;
- an Arbeitszeugnis (employment reference) that harms your career;
- disagreements about pay, holidays or working conditions.
Housing and renting
- a letting agency blaming you for damage when you move out;
- a service charge statement you don’t understand;
- serious defects in the flat that the landlord does not fix;
- disputes with neighbours or the property management.
Consumer issues and contracts
- a faulty purchase the company refuses to sort out;
- an invoice that isn’t right;
- problems with a service, a subscription or a repair;
- disagreements arising from private contracts.
Traffic
- disputes over who is liable after an accident;
- losing your driving licence;
- a dispute with a garage, dealer or leasing company;
- proceedings related to road traffic.
“No waiting period” does not mean “retrospective”
This point is essential.
Some policies apply a waiting period (Wartefrist or Karenzfrist) during which certain cover is not yet active. Others offer protection without a waiting period from the date stated in the policy.
But even a product with no waiting period does not usually cover a problem that originated before the contract started.
- today you receive a dismissal letter;
- tomorrow you take out legal protection insurance;
- the following week you want it to take on the employment dispute.
The problem had already started before the policy. Taking out cover afterwards does not turn that case into a future event.
That is why, when comparing legal protection policies, it is not enough to ask:
“Is there a waiting period?”
You also need to check how the insurer defines the moment a case arises and which earlier events are excluded.
What would have changed for the woman in the story
If she had had suitable legal protection before the dispute began, she could have reported the case from the start and asked a professional to review:
- her employment contract;
- the documented hours and payments;
- the messages exchanged with the company;
- the possible ways to make a claim;
- and the right way to respond without weakening her position.
Because the problem already existed, a new policy could not transfer that case to the insurer retrospectively.
That does not mean someone without insurance loses their rights. They can seek advice, contact the relevant bodies or consider other options. What changes is that they have to organise that help and bear any costs themselves.
Legal protection insurance does not stop the problem from happening. It stops you from having to face it alone.
Not all legal protection policies cover the same things
Before choosing, check at least these seven points:
- Areas of law included. Work, renting, consumer issues, health, personal insurance, traffic or tax may be treated differently.
- Private and traffic protection. Check whether you have one, the other or both.
- Insured persons. An individual policy is not the same as a family policy.
- Start date and waiting periods. Check from when you are covered in each area.
- Maximum sum insured and excess. Don’t compare the annual premium alone.
- Territorial scope. Switzerland, Europe or worldwide cover may vary depending on the case.
- Exclusions. Divorce, construction, self-employment, investments or earlier disputes may be excluded or have limited benefits.
When does it make sense to take it out?
The best time is when there is no dispute pending.
Especially if:
- you are employed and rely on your salary;
- you rent your home;
- you drive regularly;
- you have a family;
- you sign contracts or make major purchases;
- you want to be able to get advice before replying to a letter or accepting a claim.
As prevention, the insurance can seem invisible. Its value shows the day a letter, a dismissal, an accident or an invoice stops being a simple disagreement.
What if I already have a dispute?
Do this:
- gather contracts, letters, invoices, emails, messages and photos;
- put the events in date order;
- avoid admitting liability or signing agreements you don’t understand;
- get advice to identify the right course of action;
- and consider legal protection for future risks, knowing that the current case may be excluded.
Review your insurance before you need it
- which areas of law you are covered for
- whether you have private protection, traffic protection or both
- who is insured
- whether there is a waiting period
- what the limits and exclusions are
- and whether your policy fits your job, home and family situation
My aim is not to get you to switch insurance for the sake of it.
If your current protection is already right for you, I will tell you that too.
